1. Acceptance of Terms
By accessing or using the Attriqs website (www.attriqs.com) or platform (app.attriqs.com), you agree to be bound by these Terms of Use. If you do not agree, do not use the service. Attriqs is a product of EncubIQ ("we", "us", "our").
2. Service Description
Attriqs is a multi-touch attribution and marketing analytics platform. We provide tools for tracking, attribution modeling, marketing mix modeling, call tracking, and related analytics. The platform is provided on a subscription basis.
3. Account Responsibilities
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access. You must be at least 18 years old to create an account.
4. Acceptable Use
You agree not to: use the platform for any unlawful purpose; attempt to gain unauthorised access to our systems; interfere with other users' access; reverse engineer any part of the platform; or use the platform to collect data in violation of applicable privacy laws.
5. Data Ownership
You retain ownership of all data you input into the platform. We do not claim ownership of your attribution data, transaction records, or marketing data. See our Data Processing Agreement for details on how we handle your data.
6. Intellectual Property
The Attriqs platform, website, branding, and all associated intellectual property are owned by EncubIQ. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose.
7. Payment and Billing
Subscription fees are billed in advance on a monthly or annual basis as agreed. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice to existing subscribers.
8. Cancellation
You may cancel your subscription at any time. Upon cancellation, your access continues until the end of the current billing period. Your data is retained for 30 days after cancellation, during which you may export it. After 30 days, data is permanently deleted.
9. Limitation of Liability
Attriqs is provided "as is" without warranty of any kind. We are not liable for business decisions made based on attribution data or model outputs. Our total liability is limited to the fees paid by you in the 12 months preceding the claim.
10. Changes to Terms
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance. Material changes will be communicated via email to registered users with at least 30 days' notice.
11. Governing Law
These terms are governed by the laws of the jurisdiction in which EncubIQ operates. Any disputes will be resolved in the courts of that jurisdiction.
